VEHICLE HIRE TERMS & CONDITIONS

Definition:

Lessor: D.H.CULLEN Limited or the person, firm, company or organisation providing the service or vehicle for hire.

Hirer: The person, firm, company or organisation by or on behalf of whom this agreemnt is signed with the view to hiring the vehicle from the Lessor.

Vehicle: The vehicle described on the rental agreement or any replacement supplied by the Lessor.

Identification (ID):

Before hire can commence, the relevant driving license and counterpart section for all named drivers needs to be provided to D.H. CULLEN. In addition, photo ID in the form of a Passport / proof of address in the form of a utility or Council Tax bill and a credit or debit card statement relating to the card used for security & excess deposit. Eligible copies are only accepted by email, or Whatsapp but originals must be produced on the day of hire.

Insurance:

The inclusive Fully Comprehensive insurance covers the named driver only. Charge for any other additional driver is £10 +VAT per day subject to our strict hire criteria & insurer’s approval up to a maximum of 3 drivers.

Age and Licence Restrictions:

All drivers must be aged 28 to 70 years old and held a full licence for a minimum of two years. They must have no more than 6 current points on their licence and are subject to approval on completion of an insurance proposal form. Any convictions for drink or drug driving, dangerous or careless driving within the past 5 years will not be accepted. Overseas licenses are accepted subject to the above conditions.

Booking & Cancellation:

Bookings are only confirmed when paid for in full, which must be at least 60 days before the hire commences or at the time of the booking (if less than 60 days). Cancellations Charges: 60-31 days prior to hire date – 50% refund of hire charge, subject to a minimum charge of £80 +VAT. 30-15 days prior to hire date – 25% refund of hire charge, subject to a minimum charge of £80 +VAT. Cancellations within 14 days – no refund due. This also applies to Aston Martin Adventure, Sports Car Day & Supercar Day run by Bespokes Activity Days booked through D.H.CULLEN Ltd.

Excess & Security Deposit:

(a) As a security bond
(b) As payments towards any mechanical damage which is not covered by our Insurers, eg, tyres, wheels, clutch, gearbox and which was sustained during the hire period, excluding normal wear and tear, due to misuse and abuse.
(c) As an insurance excess against any accidental damage or loss caused to the vehicle by a third party or the hirer. The hirer is liable for the amount shown as Excess Deposit. Collision Damage Waiver (CDW) is available to reduce this. Please see below.
(d) As payment for additional charges incurred during hire for excess mileage and, or, petrol reimbursement charges. The Excess Security Deposit is as per the tariff.
(e) As payment for any unpaid parking penalty charges or road traffic offence fines incurred during the hire.

In exceptional circumstances and at our discretion the Excess & Security Deposit may be taken as a bank payment to cover the points A to E listed above. Funds will be held for the full duration of the hire and any additional time required to satisfy the possibility of any further costs such as road traffic fines and parking penalties etc. up to a period of 1 month.

Liability:

Liability is limited to a refund of the hire charge. No consequential loss liability will be covered.

Collision Damage Waiver:

Where available, 
Collision Damage Waiver (CDW) reduces your liability against accidental damage to the car, including theft and vandalism, regardless of who is at fault. Please note we do not offer a CDW on Supercars or any vehicle travelling abroad. The waiver rates are:
– 50.00% discount for daily surcharge of 12.50%
– 75.00% discount for daily surcharge of 25.00%
– 90.00% discount for daily surcharge of 50.00%

Use of Vehicle:

The hirer may use the vehicle for the purpose of social, domestic and pleasure purposes only or in a non-driver ‘static’ capacity for the purpose of photo shoots or promotional events for example. The vehicles may not be used for any purposes for which they are not expressly designed. Further, the hirer will not use or permit the vehicles to be used for hire, driving tuition, towing, racing or pace-making, or for competing in any rally, or any other form of motor sport, track days, or for any illegal purpose whatsoever.

Petrol:

You will be provided with a full tank of petrol and the vehicle must be returned with a full tank. If, however, this is not the case any reimbursement for petrol will be charged at the pump price, plus £25 +VAT administration charge.

Overseas Travel:

Please note most of our cars may not be taken out of the UK. Ireland (Eire) is not part of the UK. Prior notification is required so that overseas insurance and AA Cover can be arranged. There will be an additional charge for this, and the Excess Deposit will be doubled.

Hours of Hire:

All hires are based on a maximum period of multiples of 24 hours. Weekend hire covers a start time between 9am & 5pm on the Friday and finishes at the same time on the Monday. This is the same for any period from 1 day to 7 days and above. Hires may finish before this but customers will still be charged to the end of that period.

Mileage Allowance:

The mileage allowance is 100 miles a single day, 300 miles for 3 days and weekends and 700 miles per 7 day week. Excess mileage is as per the current Tariff. Pre-paid miles are available at a reduced rate 30% off. Unused pre-paid miles are not refundable.

Delivery & collection:

Delivery / collection can be arranged anywhere in the UK mainland at a charge of £1.75 +VAT per mile each way* (from our base at London SW11 1SA) on a Monday to Friday between 9am & 5pm (minimum £50 +VAT charge each way). Delivery / collection outside these hours are subject to a surcharge. Western Europe can be quoted for. Customers can pick up and return vehicles from our base at Clapham Junction Railway Station car park, London SW11 1SA by pre-arranged appointment only.

*Airports are subject to a £15 +VAT supplement charged per visit.

Availability:

All cars are offered subject to availability.

Prices:

Prices are subject to change without prior notice, however once a car has been booked and a deposit received, we will not alter the price for that hire.
